Eco Legal Counsel is a consulting and service company established since 2006 in compliance with Italian regulations for representing Producers not established in Italy and who are subject to the legal obligations relating to the collection and treatment of waste electrical and electronic equipment (WEEE) laid down by Directive 2012/19/EU, of waste batteries and accumulators laid down by Directive 2006/66/EC and/or wanting to meet the requirement of managing the packaging and packaging waste of their products in Italy as set out by Directive 2004/12/EC.
According to the Italian WEEE implementing legislation (Legislative Decree No. 49/2014) ‘Producer’ means, among other things, “any person who, irrespective of the selling technique used, including by means of distance communication…. places on the national market Electrical and Electronic Equipment (EEE) from another Member State or from a third Country on a professional basis ”.
As for foreign producers who do not have a registered office in Italy, the Ministerial Decree establishing the National Register (Ministerial Decree 185/07) states that: “Producers must be recorded to the National Register through the Chamber of Commerce where their business place is located. Producers with no registered office in Italy must enter the National Register through an appointed legal representative in Italy to whom are entrusted all obligations on Producers set out by the Legislative Decree No. 49/2014. In such a case, Producers must register with the Chamber of Commerce where the registered office of said representative is located ”.
A similar provision is laid down by the parallel Italian waste batteries regulation (Legislative Decree No. 188/2008).
